The agreement
These terms govern your use of Issue Mint. By creating an account you accept them. If you are agreeing on behalf of a company, you confirm you are able to do so.
Your account
You are responsible for keeping your credentials secure and for everything done under your account. Accounts are for a single user. Tell us promptly if you think your account has been compromised.
Sending
By default we send your newsletters using our own sending account, at no additional charge. Because that account is shared with other publishers, how you use it affects them, and the conditions below are the price of that arrangement.
You may instead connect your own Amazon SES or SMTP account, and accounts above 15,000 subscribers do. Where you provide credentials, you confirm you are entitled to use them, you remain responsible for complying with your provider's terms, including Amazon's, and for any charges they bill you. We store credentials encrypted and use them only to send on your instruction and to run health checks.
Protecting shared sending
While we are sending on your behalf, we monitor bounce and complaint rates for your account, and we may pause your sending automatically if they pass the thresholds we set. We may also hold a large or unusual subscriber import for review before anything is sent to it, and we may limit sending volumes on trial accounts. Pausing affects sending only: your account, your list, your archive and your website stay available throughout, and we will tell you what happened and what is needed to resume.
These measures exist to stop one publisher's mailing damaging delivery for everybody else. They do not apply to publishers sending through their own account, where the consequences fall on that publisher alone.
Acceptable use
You may not use Issue Mint to:
- Send to people who did not ask to hear from you. Purchased, scraped and rented lists are not permitted.
- Send unlawful, deceptive, hateful or infringing content.
- Circumvent unsubscribe requests, or send to an address that has unsubscribed, bounced hard or complained.
- Probe, overload or interfere with the service or with anyone else's use of it.
We can suspend an account that puts other users, our providers or recipients at risk. Where it is reasonable to do so we will tell you first and give you a chance to fix it.
Your content
Your issues, subscriber list and branding remain yours. You grant us only the licence needed to host, process and deliver them on your instruction. You can export your subscribers at any time, including after cancelling.
Trial, billing and cancellation
- The trial runs for 14 days and needs no card. When it ends, the account becomes read-only until you subscribe.
- Subscriptions are billed monthly in advance in US dollars, based on total active subscribers across your newsletters.
- If your list grows beyond your plan limit we notify you and move you up, prorated. If it shrinks, you move down at the end of the period.
- You can cancel at any time and keep access until the end of the period you have paid for. We do not give partial refunds for time already used.
- Data is retained for sixty days after cancellation, then deleted. We email you before deletion.
Availability
We aim for the service to be available continuously and we do not promise it will be. There is no contractual uptime guarantee at this stage. Scheduled maintenance is announced in advance where practical.
Liability
To the extent the law allows, Issue Mint is provided as is, and our total liability in any twelve-month period is limited to the fees you paid in that period. We are not liable for lost profits, lost revenue or lost data, or for the acts of your sending provider. Nothing here limits liability that cannot lawfully be limited.
Changes
We may change these terms. Material changes are emailed to account holders before they take effect, and continuing to use the service afterwards means accepting them.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
